The Course Objective is to address key aspects of the Employee Retirement Income Security Act of 1974 (ERISA) and Employee Benefits law, particularly the Affordable Care Act, in order to identify compliance issues that health underwriters will face this year with its implementation.
Given the changes to the health underwriter industry, 49% of producers are thinking of leaving the industry because of compliance issues. Worse, even by educating yourself on the basics of PPACA, will still cause you problems complying with ERISA. This course will provide an overview of the tax laws, ERISA, PPACA and ethics provisions that health underwriters need to know in order to avoid PPACA and ERISA pitfalls, the unauthorized practice of law, and disseminating bad advice.
There are few employee benefit law experts who actually are insurance producers verses practicing in a law firm. Let alone a producer who has produced over a hundred million dollars in premiums in group health. Dean has been an ultra-successful producer who reacted to Healthcare Reform by going to law school and then to one of the top two tax law programs in the country, with the premier employee benefits program in the country, to become an expert on PPACA and insurance. Since the Supreme Court ruled the law was a tax, and that the IRS is now a co regulator with the Departments of Insurance, he knew he had to become an expert on tax law, to be able to advise his clients. He speaks on all aspects of PPACA and ERISA, as well as tax law, in a practical way that producers can relate to. How can he make money in this environment? What are the opportunities? What are the dangers?He “understands” the agent’s day to day business and will not just talk about theory.
